2024-11-04High Court dismisses attempt to block COP Yohuno’s role as Deputy IGP

The High Court in Accra has dismissed an application by lecturer Emmanuel Felix Amantey, who sought to prevent Commissioner of Police (COP) Christian Tetteh Yohuno from continuing in his role as Deputy Inspector General of Police in charge of operations.

Amantey’s claim further stated that while the Ghana Police Service regulations mention an office overseeing operations, they do not provide for a designated deputy for this role. He alleged that the creation of this specific position constituted an overreach by both the Presidency and the Police Council, describing it as a legal misstep, and filed for a judicial review on these grounds.
However, Justice Richard Apietu ruled that the High Court’s supervisory authority, which applies to adjudicatory actions from lower courts or similar bodies, was not relevant in this case. He clarified that the President and the Police Council do not function as lower adjudicating bodies and thus fall outside the court's supervisory scope.
Justice Apietu concluded that both the President and the Police Council were exercising administrative rather than adjudicative powers, which do not fall under the court’s jurisdiction for judicial review.
On this basis, he dismissed Amantey’s application, allowing COP Yohuno to continue in his capacity as Deputy IGP in charge of operations.
