Lawyers of Samuel Ofosu Ampofo, National Chairman of the National Democratic Congress have filed an application at the Court of Appeal for stay of proceedings in the High Court.
In court on Thursday, lead counsel for the NDC chairman, Tony Lithur informed the court that they have filed an application for stay of proceedings at the Court of Appeal.
He said hearing of that case is expected to be on October 23, 2019 and prayed for adjournment pending the determination of the case at Court of Appeal.
On her part, the prosecution led by the Director of Public Prosecution, Mrs Yvonne Atakorah Obuobisah informed the court that they received the motion two days ago.
She said they have subsequently filed their response to their motion for stay.
The Commercial Division of the Accra High Court presided over by Justice Samuel Asiedu has adjourned the case to November 4 by which time the application at the court of appeal would have been determined.
Meanwhile, Lawyer Tony Lithur has indicated to the court that they have filed a repeat application to have the audio recordings struck out. He said that application to struck out the charges raises constitutional issues.
It would be recalled that on July 30, a similar application was dismissed.
The NDC chairman was seeking a stay in other to appeal an earlier decision of the court which refused his application to struck out the charges of assault against.
The court while dismissing that application said the applicant has not advanced any special circumstance to warrant the grant of stay.
Case adjourned to November 4, 2019.
