Tsikata's case adjourned sine die

Accra, July 23, GNA - The Supreme Court on Wednesday adjourned the delivery of its judgment in respect of immunity of International Finance Corporation (IFC) sine die.

The court declared that the purpose for which the matter was "stayed" had elapsed and proceeded to deliver its judgment, but had to adjourn after Tsatsu Tsikata had informed it that conditions to arrest its judgment persisted.

Tsikata who represented himself intimated to the court that his application to arrest the decision of the court was pending. He said: "I am puzzled by the hearing notice served on me this morning."

Mr Joe Ghartey, Attorney General and Minister for Justice told the court that he was served the hearing notice in court about 30 minutes ago.

He informed the court that the motion to arrest the court's judgment had been fixed for July 29.

Mr Justice William Atugubah presided over the five-member panel, including Mr Justice Stephen Allan Brobbey, Mr Justice Julius Ansah, Mrs Justice Sophia Adinyirah and Mr Justice S.K Asiamah.

Tsikata, former Chief Executive of Ghana National Petroleum Corporation (GNPC) before his conviction on June 18 to serve five years imprisonment for causing financial loss to the State and misapplying public property, had gone to the court to battle the immunity of IFC. On June 25, Tsikata, notified the court that, he had filed a motion to arrest its decision in respect of its judgment on whether or not to invite the International Finance Corporation to testify in the case which was before the Accra Fast Track High Court.

This meant the court had to hold on with its decision.
