Speaker Attorney General is brought to court over anti-LGBTQ+ legislation.

Paul Boama Sefa, a private citizen, has brought the Speaker of Parliament and the Attorney General before the High Court.

He asserts that the two have violated portions of the Ghanaian constitution in their handling of the Human Rights and Family Values Bill, 2021.

He asserts that despite the law's financial implications for the consolidated fund, no fiscal impact analysis was provided to the legislature.

The Constitutional, Legal, and Parliamentary Affairs Committee of Parliament has already urged the House to approve the bill.

However, it appears this may encounter some obstacles. The person responsible for this conduct identifies himself as a farmer and private citizen from the Ashanti Region.

Paul asserts that the Speaker of Parliament is tasked with ensuring that all legislative procedures adhere to the law.

According to him, the Public Financial Management Act stipulates that any measure introduced in the legislature must be accompanied by a fiscal impact analysis. He asserts that the Human Rights and Family Values Bill does not contain this provision.

Paul cited the Attorney General's memorandum to Parliament, in which he makes the same point regarding the absence of a fiscal impact analysis.

Substantively, the plaintiff wants the court to prohibit the speaker, his delegates, and others from proceeding with the bill's processes until this is met.

The Committee previously addressed the AG's concern in its concluding report to Congress.

The individual mentioned this, noting that portions of the measure impose a cost on the consolidated fund.

The Committee noted, however, that through the proposed amendments, this will be addressed.
