The court dismisses the lawsuit against Holmos Construction.

The Tema High Court has, for the second time, dismissed an interlocutory injunction petition brought by five renowned joint heads of five composite families in Kofi Kope, a suburb of Afienya.

Nene Tettey Kojo III, Francis Akrofi Tetteh, Gbebie Nartey, Kperme Ibrahim Narh, and Numo Abban Martey, all of Afienya, are the chiefs.

Holmos Construction Limited, a leading real estate corporation in the Tema enclave, was the target of a lawsuit filed by five plaintiffs seeking an interlocutory injunction at the Tema High Court.

This is the second lawsuit filed against the company within two months by different plaintiffs requesting the same relief.

The first suit, which was submitted on February 4, 2021, and the second, which was filed on April 12, 2023, were both dismissed.

According to the trial judge, in his initial judgment on the matter, Justice Emmanuel Ankamah noted that the plaintiff failed to convince the court that his family has a legal or equitable interest in the disputed land.

However, in the second suit filed by the five plaintiffs, who claimed to be the heads of five composite families mandated to grant lands in New Jerusalem, they pleaded with the High Court to place an interlocutory injunction against Holmos Construction Limited and are seeking an order to recover possession of all portions of plaintiffs' 1054 acres allegedly trespassed by Holmos and its grantees.

In his ruling, however, the trial judge, Justice Emmanuel Ankamah, again denied the application and noted that the reasons why the application was denied in the first suit had not been disproven, which is why the injunction application against Holmos Construction Engineering Services Limited is denied.

Holy Ativor, the chief executive officer of Holmos Construction Limited, is quite disappointed that the efforts of his company to construct state-of-the-art estates in the area are being deliberately thwarted by individuals who claim to be family members in the area.

"These are the same people wearing different suits; why should they deprive their community of development in such a manner when they are well aware that the company has gone through the proper channels?"

He asserts that Holmos Construction is committed to ensuring that the vision of constructing a 21st-century estate in New Jerusalem near Afienya is realized.

Rather than adopting a "pull him down" stance, he urged all aggrieved parties to pursue development and employment opportunities for the region and its inhabitants.

"I am open to dialogue if necessary, but as it stands, Holmos Construction has a legally acquired land title certificate covering our possession, and we are unshaken and unfazed by these trivial distractions"

Before the trial judge could even render a decision on the matter on Friday, April 28th, all five plaintiffs who filed the lawsuit along with their supporters who were present at the courthouse in the morning had vanished and no one was present in the courtroom. Uncertainty surrounds the explanation for their disappearance.

They had earlier gathered a large throng outside the courtroom in preparation for victory celebrations. However, for whatever reason, they all disappeared.
