Farmer sues Speaker of Parliament over LGBTQ+ bill

A farmer from the Ashanti Region is taking legal action against the Speaker of Parliament and the Attorney General over the anti-LGBTQ+ bill. Find out why and what he's seeking.

Paul Boama Sefa has taken legal action against Alban Bagbin, the Speaker of Parliament, and Godfred Yeboah Dame, the Attorney General, regarding the anti-LGBTQ+ bill. Mr. Sefa, who resides in the Ashanti Region, claims that the Speaker and the Attorney General have violated the constitution while handling the Proper Sexual Human Rights and Ghanaian Family Values Bill.

According to Mr. Sefa, the Parliament did not conduct a proper financial assessment of the bill despite its potential financial implications. He argues that the requirements outlined in section 100(1) of the Public Financial Management Act, 2026 (Act 921), which state that the bill should be accompanied by a fiscal impact analysis when it was initially presented in Parliament, were not met and are still not being followed.

Mr. Sefa believes that this disregard for the law by the Speaker indicates a deliberate intention to violate the country's legal principles. He further asserts that the Speaker of Parliament intentionally neglected to adhere to the provisions of the law, despite being well aware of the necessary statutory conditions that must be fulfilled before presenting the bill.

In his legal plea, Mr. Sefa requests various orders, including one that prohibits the Speaker, his deputies, agents, assigns, and privies from proceeding with any actions related to the bill until they comply with the statutory provisions outlined in section 100(1) of the Public Financial Management Act, 2026 (Act 921). He also seeks an order that requires the Speaker, his deputies, agents, and privies to ensure compliance with section 100(1) of the Public Financial Management Act, 2016 (Act 921) before taking any further steps in relation to the bill.

Additionally, Mr. Sefa seeks a permanent injunction that would prevent the defendants from committing further violations of the Public Financial Management Act, 2016 (Act 921). He also requests any other relief that the court deems appropriate in this matter.
