Fraudster make’s hospital his prison

The Greater-Accra Regional Hospital (Ridge Hospital) and the Prison Authorities are getting more and more pressure to look into a strange case involving a prisoner who has been getting treatment at the hospital for almost two months, even though he is supposed to serve 15 years at Nsawam Maximum Prison.


David Aseye Tay was found guilty of 23 counts of stealing over $6 million from a licenced Bulk Distribution Company (BDC), Misyl Energy Company Limited, by using tricks in 2018.

An Accra High Court gave Tay a 15-year jail sentence because he was the Managing Director of Renaizance Oil Limited, which was not licenced as an Oil Marketing Company (OMC).

But instead of going to Nsawam Maximum Prison to serve his time, Tay is said to have been living at Ridge Hospital under the guise of being very sick. The reasons why he was hospitalised and how long he was there have raised a lot of questions and worries.

It is said that soon after Tay was moved from the courts, he pretended to be sick and asked to go to Ridge Hospital to see his own doctor. Surprisingly, the people in charge at Nsawam Prison let him go to the hospital. When he got there, he was taken in, and he has been there ever since, even though neither the courts nor the suit knew who he was.

Sources say that Tay is doing well in the hospital and that family and friends visit him often. Some people say that he even leaves the hospital and goes home to see his family sometimes.

Strangely, this isn't the first time Tay has done something like this. He is said to have used a similar plan before to get out of jail after being arrested on the same charges. Back then, he claimed to be sick and lied to doctors at Ridge Hospital about having surgery to get them to keep him there.

The big question is why David Aseye Tay has been allowed to stay at Ridge Hospital for so long, even though he is supposed to be in Nsawam Prison for 15 years. People have questioned how the Nsawam Prison Authorities are handling the situation. They are worried that it is not right to put a convicted criminal in a hospital for such a long time without clear medical reasons.

More and more people are demanding that the jail, the court that sentenced him, and Ridge Hospital look into what happened as soon as possible. During the investigation, it is important to be open and honest, and the public has a right to know how things are going and what has been found.

David Aseye Tay's case could lead to a review of rules and policies about hospitalising prisoners, so that similar things don't happen in the future.

FACTS OF CASE

David Aseye Tay was given a 15-year prison term after being found guilty on 23 counts of defrauding by false pretence, which added up to more than $6 million. This will happen in the last week of May 2023.

His sentence came after he accepted that he stole oil products from licenced Bulk Distribution Company (BDC), Misyl Energy Company Ltd., in 2018. Misyl Energy Company Ltd. is owned by Dr. Nick Danso Adjei and imports finished oil products.

After a more than two-year trial at the Criminal Division of the High Court in Accra, presided over by Justice Lydia Osei Marfo, Mr. Tay was found guilty on all charges, including fraud by false pretence, giving out fake checks, and laundering money, among other things.

The amount in our local currency, GHc27.9 million, was worth $6 million in 2018 when 1 USD was worth 4.67 GHc.

At the trial for SUIT NO. CR/0140/2020, THE REPUBLIC VS. DAVID ASEYE TAY, the judge gave an ORDER OF RESTITUTION as part of his decision.

The orders said that all of the property the accused bought with the money he got from the Misyl Energy Company goods he stole should be taken over by the company that was wronged and sold to help pay for some of the costs.

The Court's Restitution Orders were for some houses and cars that were found in Accra. The court also said that a G&G running licence worth GH1.3 million and seven petrol stations all over Ghana could be taken away and sold.

Mr. Aseye Tay is known as a tough guy in his community, and the judge who gave her ruling called him "one living like a spoiled prince." He is said to be able to get out of trouble, but he couldn't this time when he was brought before the Criminal Division of the High Court in Accra, where Justice Lydia Osei Marfo was in charge.
