JUST IN: John Mahama Sued

A Ghanaian citizen has filed a lawsuit against former President John Dramani Mahama over his attempt to run for a second term on the National Democratic Congress (NDC) ticket.

In the lawsuit filed by the Plaintiff, Kenneth Kwabena Agyei Kuranchie, he requests that the Supreme Court disqualify the former president from running for political office in the future.

According to Article 66 (1) of the 1992 Constitution, a person seeking a second presidential term must be an incumbent president, and in the case of former President Mahama, he is only seeking to recontest after being out of office for approximately eight years.

According to a provision in the constitution, a former president seeking re-election is required to seek parliamentary sanction before pursuing his goals.

The plaintiff in the lawsuit also listed a number of reliefs he desires:

He wants the court to order the former president to disclose in detail to parliament the terms of his engagement as the NDC candidate.

Mr. Agyei Kuranchie also requests that the Supreme Court instruct the Speaker of Parliament to invoke and implement Article 68(2) of the 1992 Constitution, which states that

[The President shall not, upon leaving office as President, occupy any office of profit or emolument, directly or indirectly, in any establishment other than the State, except with the permission of Parliament].

The Plaintiff is also requesting that the court order former presidents John Agyekum Kufuor and John Dramani Mahama to disclose to parliament all agreements unrelated to the affairs of the State of Ghana.

He also wants the court to order Mr. Mahama to seek parliamentary sanction for his candidacy as the NDC's presidential candidate, or to abandon his presidential ambitions.
