Afenyo-Markin vs. The Speaker: There’s No Winner – Martin Kpebu

Private legal practitioner Martin Kpebu has criticized the Supreme Court's decision on the Speaker of Parliament's declaration of vacant parliamentary seats, following a petition by Efutu MP Alexander Afenyo-Markin.

Speaking on Joy FM, Kpebu accused the judiciary of overreaching by "amending" the constitution through interpretation, emphasizing that laws should remain as written.

He cited a warning by Lawyer Tsatsu Tsikata that judicial overreach could undermine constitutional governance. Kpebu also called for greater transparency, suggesting that the executive's involvement in Supreme Court appointments be minimized to safeguard impartiality.

Meanwhile, Thaddeus Sory, lawyer for the Speaker, argued the ruling didn’t nullify the Speaker’s decision. He noted procedural flaws, as the plaintiff’s case didn’t formally address events that occurred after filing, raising questions about the Court’s jurisdiction and final orders.
