Former Supreme Court Justice William Atuguba has voiced concerns over the Supreme Court's handling of a recent case regarding vacant parliamentary seats, arguing that it overstepped by taking on a matter meant for the High Court.
Atuguba emphasized that, under Ghana’s Constitution, specifically Article 130, the High Court has authority over parliamentary vacancy disputes. He suggested that only specific constitutional questions should be referred to the Supreme Court.
In response, Frank Davies, Chairman of the NPP’s Constitutional and Legal Committee, countered that Atuguba’s remarks were premature and could harm public confidence in the judicial process.
