Vacant seats: Reasons why two Supreme Court Justices dissented

In a recent ruling, the Supreme Court of Ghana overturned Speaker Alban Bagbin's decision to declare four parliamentary seats vacant.

While the majority upheld Majority Leader Alexander Afenyo-Markin’s suit, two justices dissented, questioning the court’s jurisdiction.

Justice Lovelace-Johnson argued that disputes about vacated parliamentary seats should be handled exclusively by the High Court, asserting that filing the case in the Supreme Court was improper.

Justice Tanko Amadu labeled the majority's decision an "aberration," contending it disrupts established judicial norms and oversteps the High Court’s authority.

Both justices voiced concern over the decision’s potential constitutional implications and expressed hope it would eventually be reconsidered.
